DM Partner Terms of Service

1. Acceptance of Terms

These Terms govern your access to and use of DM Partner (the “Service”). By using the Service, you agree to these Terms. If you use the Service for an organization, you confirm that you have authority to bind that organization.

2. The Service

DM Partner provides AI-assisted content and media generation, a public First Post Preview, social post creation and scheduling, campaign planning, media management, analytics, and related account and subscription features. One First Post Preview consists of one core idea, five platform-specific drafts, and one promotional image. A preview is a draft only: nothing is scheduled or published by that public flow.

Features and supported providers may change. We do not guarantee uninterrupted availability or that generated content will be error-free or suitable for your purpose.

3. Accounts and Acceptable Use

You must provide accurate information, protect your credentials, and notify us of unauthorized use. You may not use the Service unlawfully; infringe another person’s rights; distribute malicious code or spam; scrape or overload the Service; evade preview allowances, access controls, or security features; or submit content you do not have the right to use.

4. Third-Party Services

The Service may integrate with:

• Social platforms: Facebook, Instagram, Threads, TikTok, YouTube, and other platforms shown in the Service.
• AI and media providers: OpenAI, Anthropic, Replicate, and other providers selected for an enabled feature.
• Cloud and media services: Amazon Web Services and Cloudinary.
• Payment processors: PayFast, PayPal, or Stripe, depending on region and payment method.

Your use of a third-party service is also governed by that provider’s terms and policies. Provider availability, permissions, limits, and review requirements are outside our control.

5. Content and AI Output

You retain your rights in content you submit. You grant us a non-exclusive licence to host, process, transform, and transmit it only as reasonably needed to operate and support the Service.

AI-generated text and media can contain errors, omissions, unsupported claims, or unsuitable material. You are responsible for reviewing, editing, and approving all output before use or publication and for complying with applicable law, advertising standards, intellectual-property rights, and platform rules.

6. Publishing and Connected Accounts

You control which supported accounts are connected and which content is submitted for publishing. Platform APIs may reject, delay, alter, or remove content. You remain responsible for account permissions, the selected destination, publication timing, and the published content.

7. Paid Services

If you buy a paid plan or usage package, you agree to the price, billing interval, taxes, limits, and checkout terms shown at purchase. Refunds and cancellations are handled according to those checkout terms, applicable law, and the relevant payment method. Pricing or plan changes will be communicated as required by applicable law.

8. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect information.

9. Suspension and Termination

You may stop using the Service at any time. We may restrict or suspend access where reasonably necessary to address a breach, security threat, legal obligation, non-payment, provider restriction, or material risk to the Service or other users.

10. Disclaimers and Liability

The Service is provided on an “as available” basis to the extent permitted by law. To the maximum extent permitted by law, DM Partner is not liable for indirect, incidental, special, consequential, or punitive loss arising from use of the Service. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

11. Changes

We may update these Terms. Material changes will be communicated through the Service, by email, or by updating this page, as appropriate. The date above identifies the current published version.
